These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you”, “your”, or “customer”) and Kixcure (“Kixcure”, “we”, “us”, or “our”), the operator of the website https://kixcures.com and all associated pages, applications, and services (collectively, the “Website”), governing your access to and use of the Website, including browsing, account creation, and the purchase of shoe cleaning foam, deep cleaner, brushes, towels, and related shoe-care Products (“Products”).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE WEBSITE. By accessing, browsing, registering on, or placing an order through the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated herein by reference. If you do not agree with any part of these Terms, you must discontinue use of the Website immediately.
1. Eligibility
Use of the Website is available only to individuals who are at least 18 years of age and who are competent to enter into a legally binding contract under the Indian Contract Act, 1872. If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian, who shall be responsible for all activities conducted on your behalf. By using the Website, you represent and warrant that you meet these eligibility requirements.

Certain features of the Website, such as order tracking and saved addresses, may require you to create an account. When registering, you agree to:

3. Products, Pricing, and Availability
We make reasonable efforts to display accurate descriptions, images, and prices for our Products. However:
Product images are for illustrative purposes; actual packaging, colour, or minor formulation details may vary slightly;
Prices are listed in Indian Rupees (INR) and are inclusive or exclusive of applicable taxes as indicated on the Website at checkout;
Prices, discounts, and offers are subject to change without prior notice and may vary across promotional periods;
Product availability is subject to stock; we reserve the right to limit quantities, discontinue Products, or refuse orders at our discretion, including where a pricing or listing error has occurred.
In the event of a pricing or product description error, Kixcure reserves the right to cancel any order arising from such error and to issue a full refund of any amount paid.
4. Orders and Acceptance
Placing an order through the Website constitutes an offer by you to purchase the selected Product(s), subject to these Terms. An order is not accepted, and no contract of sale is formed, until we send you a dispatch confirmation. Kixcure reserves the right to accept or decline any order, in whole or in part, for reasons including but not limited to Product unavailability, suspected fraudulent activity, errors in pricing or description, or non-serviceability of the delivery address.
5. Payments
We accept payments through the methods displayed at checkout, which may include credit/debit cards, UPI, net banking, digital wallets, and Cash on Delivery (where available). All online payments are processed through secure, RBI-authorised third-party payment gateways; Kixcure does not store your complete card details, CVV, or UPI PIN. You represent that any payment information you provide is accurate and that you are authorised to use the chosen payment method.
6. Shipping and Delivery
Shipping timelines, charges, and related terms are governed by our Shipping Policy, which forms part of these Terms. Estimated delivery dates are provided in good faith but are not guaranteed.
7. Returns, Replacements, and Refunds
Returns, replacements, and refunds are governed by our Return & Refund Policy, which forms part of these Terms and sets out eligibility conditions, timelines, and the process for raising such requests.
8. Product Use and Safety
Our Products are intended for external cleaning and care of footwear only, in accordance with the instructions provided on the packaging and label. You agree to:
Use Products strictly as directed, including performing a patch test on an inconspicuous area before first use on any new material;
Keep Products out of reach of children and avoid contact with eyes, skin, and mucous membranes beyond ordinary incidental exposure during use;
Store Products in a cool, dry place away from direct sunlight and heat, as indicated on the packaging;
Discontinue use and seek appropriate medical or professional advice if irritation, discolouration, or damage to footwear occurs, and contact us so we can assist and investigate.
Kixcure Products are cleaning formulations and are not intended for ingestion, use on skin as a cosmetic product, or use on materials other than footwear unless expressly stated on the packaging.
9. Intellectual Property
All content on the Website, including but not limited to the Kixcure name, logo, trademarks, text, graphics, images, product photography, videos, layout, and software (collectively, the “Content”), is the property of Kixcure or its licensors and is protected under applicable Indian and international intellectual property laws, including the Copyright Act, 1957, and the Trade Marks Act, 1999.
You may view, download, and print Content solely for your personal, non-commercial use in connection with browsing and purchasing Products. You may not reproduce, distribute, modify, publicly display, create derivative works from, or otherwise exploit any Content for commercial purposes without our prior written consent.
10. User Conduct
When using the Website, you agree that you will not:
Violate any applicable law, regulation, or third-party right;
Use the Website for any fraudulent, unlawful, or unauthorised purpose, including placing fraudulent orders;
Attempt to gain unauthorised access to the Website, its servers, or any connected network or database;
Introduce viruses, malware, or other harmful code, or engage in activity that disrupts or interferes with the operation of the Website;
Scrape, harvest, or otherwise collect information about other users without their consent;

We reserve the right to remove or decline to publish any User Content at our sole discretion.

We are not responsible for the content, privacy practices, or terms of any third-party websites, and your interactions with such third parties are solely between you and them.
13. Disclaimer of Warranties
The Website and Products are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Kixcure disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be excluded under the Consumer Protection Act, 2019, or other applicable law. We do not warrant that the Website will be uninterrupted, error-free, or free from viruses or other harmful components.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Kixcure, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Website or Products, whether based on contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.
Nothing in these Terms shall exclude or limit Kixcure’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019. Subject to the foregoing, Kixcure’s aggregate liability arising out of or relating to any order shall not exceed the total amount paid by you for the Product(s) giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless Kixcure, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Website or Products, or your violation of any applicable law or third-party right.
16. Force Majeure
Kixcure shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay arises from causes beyond its reasonable control, including natural disasters, pandemics, government action, strikes, courier or logistics disruptions, internet or telecommunications failures, or other force majeure events.
17. Suspension and Termination
We reserve the right, at our sole discretion, to suspend or terminate your access to the Website or your account, without prior notice, if we believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or for any other reason we consider necessary to protect the Website, our Products, or other users. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to any mandatory consumer protection rights that permit you to bring proceedings in your local jurisdiction, you agree that any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts at Delhi, India.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or authority of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.
21. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Kixcure regarding your use of the Website and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

Kixcure reserves the right to modify, amend, or replace these Terms at any time, at our sole discretion.
